1. Acceptance
These Terms of Use govern your use of lnhcapital.com (the “Site”), operated by LNH Capital LLC (“LNH Capital,” “we,” “us”). By using the Site or submitting a form, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site. You must be at least 18 years old to use the Site.
2. Our services
LNH Capital is a hard money lender. We offer short-term and fix and flip loans to real estate investors. Our loans are business-purpose loans only. They are not available for personal, family or household purposes, or for an owner-occupied home.
3. No offer to lend
Nothing on the Site is an offer to lend or a commitment to make a loan. Rates, terms, leverage, fees and programs shown on the Site are examples only and can change without notice. Every loan is subject to application, underwriting, appraisal or valuation, title review, credit review, documentation and final written approval by LNH Capital. Only a signed loan commitment or loan documents set the terms of a loan.
Submitting an application or a pre-qualification form does not mean you are approved.
4. Your information
You agree that the information you give us is true and complete. You authorize us to verify it and, where you sign a credit authorization, to obtain credit reports. Giving false information on a loan application may be a crime.
5. Text messages and calls
If you give us your phone number and agree, we may call and text you about your inquiry and loan, and, only with your separate consent, about our loan programs. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to marketing texts is not a condition of any loan.
6. No legal, tax or financial advice
Content on the Site is general information. It is not legal, tax, accounting, investment or financial advice. Talk to your own advisors before making any investment or borrowing decision.
7. Intellectual property
The Site and its content, including text, graphics, logos and the LNH Capital name, belong to LNH Capital or its licensors. You may view and print pages for your own business use. You may not copy, republish, sell or create works from Site content without our written permission.
8. Acceptable use
You agree not to use the Site to break the law, submit false or fraudulent information, interfere with the Site’s security or operation, scrape the Site, or impersonate anyone.
9. Third-party links and tools
The Site may link to or use third-party services, such as our loan application portal. We are not responsible for third-party sites or services, and their own terms apply.
10. Disclaimers
The Site is provided “as is” and “as available.” To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be error-free or always available.
11. Limitation of liability
To the extent the law allows, LNH Capital and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Site. Our total liability for any claim about the Site is limited to $100. These limits do not apply to the terms of any signed loan documents, which control.
12. Indemnity
You agree to defend and hold harmless LNH Capital and its owners, employees and agents from claims, losses and costs (including reasonable attorneys’ fees) arising from your misuse of the Site, your breach of these Terms, or false information you provide.
13. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute not subject to arbitration will be brought only in the state or federal courts located in Los Angeles County, California.
14. Dispute resolution
Before filing any claim, you agree to contact us at legal@lnhcapital.com and give us 30 days to try to resolve it informally. Disputes about a loan are governed by the dispute terms in the loan documents.
15. Changes
We may change these Terms by posting a new version on this page with a new effective date. Continued use of the Site after a change means you accept it.
